📃Terms of use (mobile app)

These Terms of Use ("Terms") govern your use of the mobile app (the "mobile app”) and any related services provided by Bolide ("we," "us," or "our"). By accessing or using the mobile app, you agree to be bound by these Terms. If you do not agree with any provision of these Terms, you should not use the Mobile app.
1. Acceptance of Terms By accessing and using the mobile app, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also represent that you have the legal authority to accept these Terms on behalf of yourself or any party you represent. If you do not agree to these Terms, you may not use the Mobile app.
2. Modification of Terms We reserve the right to modify these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting on the Mobile app. Your continued use of the Mobile app after the posting of revised Terms constitutes your acceptance of such changes. It is your responsibility to review the Terms regularly to stay updated with any modifications.
3. Mobile app Content The content on the Mobile app is provided for general informational purposes only and does not constitute professional advice or recommendation. We strive to ensure the accuracy of the information provided on the Mobile app but make no warranties or representations regarding its completeness, reliability, or suitability for any purpose. You acknowledge that your use of any information on the Mobile app is at your own risk.
4. Intellectual Property Rights All intellectual property rights, including copyrights, trademarks, and patents, in the mobile app and its content, belong to Bolide or its licensors. You are granted a limited, non-exclusive, and non-transferable license to access and use the mobile app solely for your personal, non-commercial purposes. You may not modify, reproduce, distribute, or create derivative works based on the Mobile app or its content without our prior written consent.
5. User Conduct When using the mobile app, you agree to abide by all applicable laws and regulations and to respect the rights of others. You agree not to engage in any of the following activities: a) Violating any applicable laws or regulations; b) Infringing upon the intellectual property rights of others; c) Misrepresenting your identity or impersonating any person or entity; d) Transmitting any harmful, offensive, or unlawful content; e) Interfering with the proper functioning of the mobile app; f) Attempting to gain unauthorized access to any portion or feature of the mobile app.
6. Third-Party Platforms and Services The Mobile app may contain links to third-party platforms or services that are not owned or controlled by Bolide. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party platform or services. You acknowledge and agree that Bolide shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party platform or services.
You use all third-party services at your own risk and should apply a suitable level of caution and discretion in doing so. Any use of third-party services is governed solely by the terms and conditions of such third-party services and any contract entered into, or any transaction completed via any third-party services, is between you and the relevant third party, and not with Bolide. You shall comply in all respects with all applicable terms of the third-party services that you access or subscribe to in connection with the services.
7. Limitation of Liability To the fullest extent permitted by applicable law, Bolide, its officers, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the mobile app or any content or services provided through the mobile app.
8. Indemnification You agree to indemnify and hold Bolide, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees and costs, arising out of or in any way connected with your use of the mobile app or violation of these terms.
9. Governing Law and Jurisdiction
A) These Terms shall be governed by and construed following the laws of the United Kingdom. Any dispute arising out of or relating to these Terms or the mobile app shall be exclusively resolved by the courts located in the United Kingdom.
B) Bolide does not interact with, or provide services to, persons or entities subject to sanctions administered by the US Office of Foreign Assets Control ("OFAC") or those imposed by the UK Office of Financial Sanctions Implementation ("OFSI").
C) Bolide is operating in accordance with parameters enforced by the US Office of Foreign Assets Control (“OFAC”) and the UK Office of Financial Sanctions Implementation (“OFSI”) in regards to the following jurisdictions: Cuba, Iran, North Korea, Syria, Crimea region of Ukraine, Luhansk region of Ukraine, or the Russian Federation.
E) Bolide does not provide services neither to sanctioned individuals, sanctioned jurisdictions, nor minors (individuals under the age of 18).

11. Nature and Functionality of the Mobile App While the mobile app provides an interface to third-party decentralized exchanges (DEXs) and decentralized applications (dApps), it functions as a gateway or link, directing users to these external platforms without hosting or operating any exchange functionalities directly within the application itself. In essence, the mobile app acts as a bridge, connecting users with third-party service providers, either via API or other means, for the purpose of enabling decentralized digital asset transactions. Any interaction, transaction, or activity conducted on these third-party platforms is governed by the terms and conditions set forth by these respective entities, and the mobile app bears no responsibility or liability for the same. Users are urged to exercise caution and discretion when navigating and transacting on these external platforms.
12. Assumption of Risk We reserve the right to restrict your access from engaging with the mobile app. You agree that we have the right to restrict your access to the mobile app via any technically available methods if we suspect, in our sole discretion, that (a) you are using the mobile app for money laundering or any illegal activity; (b) you have engaged in fraudulent activity; (c) you have acquired cryptoassets using inappropriate methods, including the use of stolen funds to purchase such assets; (d) you are the target of any sanctions administered or enforced by the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”), the United Nations Security Council, the European Union, Her Majesty’s Treasury, or any other legal or regulatory authority in any applicable jurisdiction; (e) either you, as an individual or an entity, or your wallet address is listed on the Specially Designated Nationals and Blocked Persons List (“SDN List”), Consolidated Sanctions List (“Non-SDN Lists), or any other sanctions lists administered by OFAC; (f) you are located, organized, or resident in a country or territory that is, or whose government is, the subject of sanctions, including but not limited to Côte d’Ivoire, Cuba, Belarus, Russia, Iran, Iraq, Liberia, North Korea, Sudan, and Syria; or (g) you have otherwise acted in violation of these Terms. If we have a reasonable suspicion that you are utilizing the mobile app for illegal purposes, we reserve the right to take whatever action we deem appropriate
You further agree that you will not use a VPN or other similar devices to access the mobile app where it is prohibited by law.
13. Trading Risks and Regulatory Warnings The use of the mobile app and the integrated third-party platform or services may entail the following risks:
Digital Currencies and Digital Assets are speculative investments and involve a substantial degree of personal risk for those who hold them through mobile app. The value of a Digital Assets acquired through mobile app can quickly increase or decrease at any time, and it may even fall to zero. This means there is the risk of complete loss of capital with no legal recourse. There can be no assurance that any Cryptocurrency, or other digital asset is or will be viable, liquid, or solvent.
Don’t invest unless you’re prepared to lose all the money you invest. This is a high-risk investment and you should not expect to be protected if something goes wrong.
The purchase and sale of Digital Assets through mobile app involves significant risk and can result in substantial losses to You and Your invested capital. You should not invest more than You can afford to lose and should ensure that you fully understand the risks involved. You should therefore carefully consider whether trading or holding Digital Currency and Digital Assets is suitable, taking into consideration Your own financial situation and attitude to risk. When dealing in Digital Currencies and Assets , you may not have access to the Financial Ombudsman Service (FOS) or the Financial Services Compensation Scheme (FSCS) if something goes wrong.
Bolide may provide educational information about Digital Assets, in order to assist users in learning more about Digital Assets such as articles, links to third-party content, news feeds, tutorials, and videos. The information provided on the mobile, website or any such third-party sites does not constitute investment advice, financial advice, trading advice, or any other sort of advice, and You should not treat any of the mobile app and website's content as such. Bolide will not be held responsible for the decisions You make to buy, sell, or hold Digital Assets based on the information and/or Services provided by Bolide. Bolide does not make any representations or recommendations regarding the advisability or otherwise of the purchase or sale of Digital Assets.
You agree and understand that the sale of NFTs via our mobile app have been created and/or minted by third-party websites, individuals, or entities("Third-Party Creators").
Bolide does not exercise control over the content, quality, value or authenticity of NFTs created by Third-Party Creators. For NFTs transactions, you bear full responsibility for verifying the identity, legitimacy, and authenticity of NFTs you purchase. Notwithstanding indicators and messages that suggest verification, Bolide makes no claims about the identity, legitimacy, or authenticity of NFTs.
You understand that You may encounter NFTs that contain explicit, offensive, or inappropriate content, and You agree that Bolide is not liable for such content.
Users must comply with the terms and conditions set by Third-Party Creators when purchasing, using or transferring NFTs created by them (if any). Bolide is not responsible for any breaches of Third-Party Creator’s terms by Users.
Users acknowledge that NFTs created by Third-Party Creators may be protected by intellectual property rights, including copyright. Users agree not to infringe upon these rights and shall respect the intellectual property of Third-Party Creators.
While we may facilitate the purchase of NFT, this functionality is provided without any guarantees of uptime, functionality, or serviceability associated with the NFTs
Bolide is not responsible for repairing, supporting, replacing or maintaining any mobile app NFT marketplace, or network hosting any artwork, digital content, or other associated image or information connected or otherwise linked to the NFT (Associated Content). Bolide does not have an obligation to maintain any connection or link between NFTs and the Associated Content. The Associated Content may be removed from the NFT at any time and for any reason by third parties who control the Associated Content. Bolide is not responsible for any losses due to any Associated Content being disconnected or otherwise amended.
NFTs exist only by virtue of the ownership record maintained in the applicable blockchain network and/or distributed ledger. Any transfer of title that might occur in any unique digital asset occurs on the decentralized ledger within such blockchain network and/or distributed ledger. We do not guarantee that we can effect the transfer of title or right in any NFTs or other digital assets, or that any associated payment will be successful.

14.You accept the risks of purchasing and holding Digital Assets through Mobile App You agree and accept the risks associated with purchasing and holding Digital Currency through mobile app outlined in 13.3, including any risks associated with fluctuations in the relevant exchange rates over time and partner platform. You agree that you will not use mobile app for speculative trading.
15.Taxes You are responsible for any taxes which may be applicable to payments .You make or receive, and it is Your responsibility to collect, report and pay the correct tax to the appropriate tax authority.
